Common questions
How do you work out holiday when someone leaves?
Work out the holiday they’ve accrued up to their leaving date, then subtract what they’ve already taken. A positive number is holiday you owe them (often paid in the final wage); a negative number is holiday taken in advance, which you may be able to recover if the contract allows.
Can you deduct overtaken holiday from final pay?
Only if the contract or a written agreement allows it. Without that clause, deducting pay for overtaken holiday can be an unlawful deduction — check the contract and take advice.
Is accrued-but-untaken holiday always paid?
Yes. On termination, workers must be paid for any statutory holiday accrued but not taken. It’s the one time statutory holiday can be “paid in lieu”.
