How is TOIL calculated?
Most employers accrue time off in lieu at 1:1 — one hour worked extra earns one hour off. Some pay 1.5:1 or 2:1 for unsocial hours like weekends. Multiply the extra hours by your rate to get the TOIL banked.
Is TOIL a legal requirement?
No. There’s no legal duty to offer TOIL, but if you do, the rules (accrual rate, deadline to take it, approval) should be written down, and Working Time Regulations on rest and the 48-hour week still apply.
How long do staff have to take TOIL?
That’s up to your policy — a common approach is “use within a set period or it lapses” (often a few weeks or the end of the quarter). Whatever you choose, make it clear and track balances so time isn’t lost.
